How the Portuguese system works for self-employed workers
Portugal's tax system for self-employed workers and freelancers operates through a mechanism called recibos verdes (green receipts), which is the standard invoicing and tax framework for independent professional activity. Understanding this system is essential for anyone working freelance or self-employed in the Algarve.
To work as a freelancer in Portugal, you must first register your activity (actividade) with the tax authority (Autoridade Tributaria) through the Financas portal. This registration specifies your professional activity code (CAE) and determines your tax obligations. The registration process is done online and is relatively straightforward, though Portuguese language ability or professional assistance is helpful.
Once registered, you issue electronic invoices (recibos verdes) through the Financas portal for each payment received. The invoice records the client, the amount, the VAT applicable, and any withholding tax (retencao na fonte). Clients based in Portugal are typically required to withhold tax at source at a rate of 25 per cent (or 11.5 per cent for certain activities), which is credited against your annual income tax liability.
VAT (IVA) registration is required once annual turnover exceeds 14,500 euros (as of the current threshold). Below this threshold, freelancers can operate under the simplified VAT exemption regime (Artigo 53). Above it, VAT at the standard rate of 23 per cent must be charged on invoices and remitted to the tax authority quarterly.
Social security contributions (Seguranca Social) are mandatory for freelancers. Contributions are calculated quarterly based on income declared through recibos verdes, at a rate of 21.4 per cent of a calculated reference income. New freelancers are exempt from social security contributions for the first twelve months of activity. The calculation formula uses a fraction of declared income as the contribution base, meaning the effective rate is lower than the headline percentage.
Annual income tax (IRS) is declared by June of the following year through the Financas online portal. Freelancers can choose between two regimes: the simplified regime, which applies a coefficient to turnover to determine taxable income (effectively taxing only a percentage of gross income, depending on the activity type), or the organised accounting regime, which requires a certified accountant and allows deduction of actual business expenses. Most small-scale freelancers use the simplified regime.
The NHR (Non-Habitual Resident) regime, which offered a flat 20 per cent income tax rate on certain Portuguese-source professional income for new residents, was reformed in 2024. Replacement incentive regimes exist but have different qualifying criteria. Professional tax advice is strongly recommended for anyone considering freelance work in Portugal, as the interaction between income tax, social security, VAT, and withholding tax can be complex.
For UK nationals working freelance in the Algarve, the double taxation treaty between Portugal and the UK generally prevents income from being taxed in both countries. However, specific circumstances vary, and professional advice is essential.
The administrative burden of the recibos verdes system should not be underestimated. Quarterly social security declarations, annual income tax filing, monthly or quarterly VAT returns (if registered), and the need to issue compliant invoices for every payment received create a paperwork load that can be daunting, particularly for those unfamiliar with Portuguese bureaucracy and tax terminology.
Engaging an accountant (contabilista certificado) is not mandatory under the simplified regime but is strongly recommended. Accountancy fees for a basic freelancer are typically 50 to 100 euros per month and provide peace of mind that declarations are filed correctly and on time. The penalties for late filing or underpayment of tax or social security contributions can be disproportionate to the amounts involved, and professional guidance helps avoid costly mistakes.
